AI-Generated MAGA Influencer Faces Legal Scrutiny Over Stolen Valor Claims
An Instagram account posing as a MAGA influencer named Jessica Foster has been exposed as an AI-generated persona. The account, which falsely claimed military service, amassed over one million followers before being identified as a fake. This incident is part of a broader trend where AI-generated military personas are used to attract audiences and generate income. Legal experts, such as Eugene Volokh from UCLA, highlight that while claiming to be a service member for fame is constitutionally protected, using such claims for financial gain is punishable under federal law. The Pentagon has referred the matter to the FBI, as impersonating military personnel violates federal law. Meta, the owner of Instagram, requires disclosure of AI-generated content but has not clarified enforcement measures.
