State Laws Challenge AI Surveillance on Roads, Impacting Privacy
AI-powered surveillance technologies, such as automatic license plate readers (ALPRs) and AI-equipped drones, are increasingly used by law enforcement across the United States. Companies like Flock Safety provide these technologies, which are capable of tracking vehicles and individuals, raising significant privacy concerns. In response, various state legislatures are enacting laws to regulate the use of these technologies. For instance, Illinois has implemented the Biometric Information Privacy Act (BIPA), which restricts the use of biometric data without consent. Other states, like California, have classified ALPR data as personal information, requiring additional protections. Some states, including Florida and New Hampshire, have passed laws limiting the details that police cameras can capture, such as prohibiting the recording of individuals inside vehicles. These legislative efforts aim to balance the benefits of AI surveillance for law enforcement with the protection of individual privacy rights.
