Louisiana Enacts Law Banning Debit Card Surcharges, Expanding Consumer Protections
A new law in Louisiana, Senate Bill 254, has taken effect, prohibiting retailers from imposing surcharges on customers who use debit cards for payments. This legislation aims to protect consumers by preventing additional charges that increase transaction costs when using debit cards instead of cash, checks, or credit cards. The law does not apply to credit card transactions. Consumers who are unlawfully charged can recover actual damages, but must first provide written notice to the retailer. If the retailer reimburses the surcharge within 30 days, legal action cannot be pursued. The law also empowers the Louisiana attorney general to take civil action against violators, potentially recovering attorney fees and court costs. Businesses that violate orders under this law may face civil penalties up to $500 per violation.
