Federal Court Upholds Arkansas Act 372, Impacting Librarians and Booksellers
A federal court has upheld Arkansas Act 372, a law that criminalizes librarians and booksellers for providing materials deemed inappropriate for minors. The law, which lacks clear definitions of what constitutes inappropriate material, allows for the prosecution of librarians and booksellers if they provide age-appropriate LGBTQ+ materials or books about puberty. This decision has led to a chilling effect in Arkansas public libraries, with librarians facing potential jail time for their professional duties. The law was initially challenged in court for being vague and overreaching, but the Eighth Circuit Appeals Judge L. Steven Grasz overturned a previous ruling that declared parts of the law unconstitutional. The decision has been praised by Arkansas Attorney General Tim Griffin, while the Arkansas chapter of the American Civil Liberties Union has criticized it for threatening the freedom to read.
