New York Appellate Division Denies PSQIA Privilege in Landmark Decision
In a significant ruling, New York's Appellate Division, Third Department, has directed the disclosure of documents previously claimed to be privileged under the Patient Safety and Quality Improvement Act (PSQIA). The case, Adams v. Bassett Healthcare Network, marks the state's first appellate-level decision involving this federal protection. The court found that the healthcare provider failed to demonstrate that the documents were submitted to and used by its quality assurance committee, a requirement for claiming privilege under the PSQIA. This decision could set a precedent for future cases involving the PSQIA in New York.
