New York Implements Ban on Credit Checks in Employment Decisions to Promote Equity
New York has enacted a law prohibiting the use of credit checks in employment decisions, effective April 18. This legislation, signed by Governor Kathy Hochul, aims to make hiring practices more equitable by limiting the use of consumer credit history, which is not directly related to job performance. The law includes exceptions for positions requiring security clearance, law enforcement roles, financial authority, or access to trade secrets. New York joins ten other states and several major cities in implementing similar restrictions. The law reflects a broader trend towards reducing reliance on screening tools that could lead to discrimination in employment.
