Arizona Court Overturns Manslaughter Sentence Due to AI-Generated Victim Video
The Arizona Court of Appeals has overturned a 10-year manslaughter sentence for Gabriel Paul Horcasitas, citing the use of an AI-generated video of the deceased victim, Christopher Pelkey, during the sentencing hearing. The court ruled that the AI video was unreliable and crossed the line by presenting statements as if directly from the victim, rather than reflecting actual events. The video, created by Pelkey's sister, aimed to humanize the victim and convey his thoughts, including a belief in forgiveness and a sentiment that he and Horcasitas could have been friends in another life. This marks a significant legal development, as it is believed to be the first instance in U.S. courts where an AI-generated victim impact statement led to an overturned sentence. Horcasitas was convicted of manslaughter in Pelkey's 2021 shooting death during a road rage incident in Chandler, Arizona.
