Lowy Institute Discusses Sovereignty Disputes in South China Sea Joint Development
The Lowy Institute has explored the challenges of joint development in the South China Sea, focusing on sovereignty disputes that hinder cooperation. Despite past attempts at joint development, such as the 2005 Joint Marine Seismic Undertaking between the Philippines, China, and Vietnam, these efforts have failed due to differing interpretations of sovereignty. The Philippine Supreme Court's 2023 ruling against joint exploration with China highlights the constitutional constraints and sovereignty concerns that complicate such agreements. The 2016 tribunal ruling in favor of the Philippines' claims further complicates negotiations, as it requires China to accept a decision it rejects.
