Illinois Enacts New Law to Safeguard Families Against Wrongful Child Abuse Accusations
Illinois Governor JB Pritzker signed a new law in July aimed at preventing wrongful accusations of child abuse or neglect stemming from medical evaluations. The legislation, which passed the General Assembly unanimously, addresses concerns raised by family-rights advocates about medical findings being misinterpreted as abuse. Starting next year, when the Illinois Department of Children and Family Services (DCFS) requests a medical or forensic opinion during an abuse investigation, parents or guardians must be informed within 24 hours about the professional's specialty and subspecialty. They will also have the right to seek a second medical or forensic opinion at their own expense, which DCFS must consider as evidence. Additionally, DCFS is mandated to post an informational document on its website by July 1, 2027, detailing its response to abuse allegations, the role of medical evaluations, and parents' rights, including seeking second opinions and legal counsel.
