Arizona Court of Appeals Vacates Chandler Road Rage Sentence Due to AI Victim Video
The Arizona Court of Appeals has vacated the 10 1/2-year prison sentence of Gabriel Horcasitas, who was convicted of manslaughter in a 2021 road rage killing in Chandler. The court's decision was based on the finding that an AI-generated video of the victim, Christopher Pelkey, played during the sentencing, prejudiced the judge and made the decision fundamentally unfair. Pelkey's family had created the AI video using a previously recorded video, a picture, and a script written by Pelkey's sister. During the sentencing, the judge explicitly noted the "obvious forgiveness" expressed in the AI statement and remarked that he "loved that AI" and that Pelkey was able "to speak from his heart" as the family envisioned. While Horcasitas' manslaughter conviction remains upheld, he will now face resentencing.
