Senate Subcommittee Grills USPTO Director on Fee-Setting Authority and Patent Policies
The Senate Judiciary Subcommittee on Intellectual Property recently conducted an oversight hearing to examine the United States Patent and Trademark Office (USPTO). The session, held on September 29, focused on the USPTO's fee-setting authority and the discretionary-denial policy of the Patent Trial and Appeal Board (PTAB). Director John A. Squires was the sole witness at the hearing. During the proceedings, Senator Adam Schiff (D-CA) challenged Director Squires on the USPTO's quality claims, requesting written responses regarding layoffs, reductions in remote work, and quotas. Director Squires indicated his intention to maintain discretionary denial authority while returning merits decisions to PTAB panels, a reversal of previous centralization efforts. Senator Peter Welch (D-VT) dismissed Squires' characterization of pharmaceutical patent disputes as complex, stating, 'It hasn't gotten complex, it's pretty simple.'
