China's Supreme People's Court Issues Guidelines on AI Deepfakes and Algorithmic Discrimination
China's Supreme People's Court (SPC) has released new guidelines addressing the legal implications of AI-generated content, including deepfakes, voice cloning, algorithmic price discrimination, and AI-generated false information. These guidelines clarify that individuals cannot use AI to create or distribute recognizable digital replicas of others without their explicit consent. Such unauthorized use is considered an infringement of personal rights. Furthermore, using AI-generated faces or voices to spread false claims or damage reputations can lead to legal liability. The SPC's rules also target businesses that employ algorithms to offer varied prices or transaction terms for identical goods or services without justifiable reasons, holding them liable if such practices harm consumers.
