AILA Submits Comments Opposing USCIS Naturalization Fee Increases and Elimination of Fee Waivers
The American Immigration Lawyers Association (AILA) has submitted formal comments to the U.S. Citizenship and Immigration Services (USCIS) opposing proposed adjustments to naturalization application fees. AILA argues that the proposed rule, which would substantially increase filing fees for Form N-400 (Application for Naturalization) and Form N-336 (Request for a Hearing on a Decision in Naturalization Proceedings), and eliminate reduced-fee options and fee waivers, is arbitrary and capricious. AILA contends that these changes would create significant financial barriers to naturalization for eligible lawful permanent residents, particularly those with lower incomes, without adequate consideration of less burdensome alternatives or the public benefits of naturalization. The proposed increase for Form N-400 is from $760 to $1,330, a 75% hike.
