Federal Appeals Court Allows Arkansas 'Harmful to Minors' Law to Proceed
A federal appeals court has lifted an injunction that was blocking the enforcement of an Arkansas law criminalizing the distribution of books deemed 'harmful to minors' to individuals under 18. The decision by the US Court of Appeals for the Eighth Circuit comes after Arkansas prosecutors and the state's attorney general argued for the law's enforcement. The law had been challenged by a group of public libraries and booksellers, who claimed it was unconstitutionally overbroad under the First Amendment and vague under the 14th Amendment's Due Process Clause. However, the court found that the plaintiffs failed to prove their case and lacked standing to challenge the law.
