The case, initiated by environmental organizations, questions whether TotalEnergies' climate strategy aligns with the law, which mandates large companies to identify and mitigate human rights and environmental risks. TotalEnergies argues that the law does not apply to global climate change or the downstream use of its products by customers. The company supports the French Public Prosecutor's stance that climate change is a global issue beyond the law's scope. TotalEnergies also contends that the European Corporate Sustainability Due Diligence Directive does not extend corporate responsibility to customer activities, which would be inconsistent with legal principles.
