Alabama State Bar Issues Guidance on Ethical AI Use for Legal Professionals
The Alabama State Bar has released new guidance on the ethical use of artificial intelligence (AI) within the legal profession. This guidance does not introduce new ethical rules but clarifies how existing professional responsibilities apply to AI tools. Lawyers are expected to understand the capabilities and limitations of AI tools and ensure that AI-generated outputs are verified before use. This is particularly important in light of recent cases where AI-generated content led to legal missteps, such as the Alabama Supreme Court case where an attorney was sanctioned for submitting a brief with fictitious AI-generated legal references. The guidance emphasizes that lawyers remain responsible for AI-assisted work, similar to work done by non-lawyer assistants. Legal departments are encouraged to implement AI-use policies, conduct vendor diligence, and ensure human oversight in AI processes.
