Texas Appeals Court Reverses Injunction Against Midwife Accused of Violating Abortion Ban
A Texas appeals court has reversed a temporary injunction against Maria Margarita Rojas, a midwife accused of performing illegal abortions and practicing medicine without a license in Houston. The injunction, issued by a lower court in Waller County, had shut down three clinics where Rojas worked. The Fifteenth Court of Appeals in Austin found that the state did not provide sufficient evidence to support the injunction, particularly criticizing the use of probable-cause affidavits from Rojas' separate criminal case. The court's decision does not address the truth of the allegations against Rojas but focuses on the procedural aspects of the injunction. Rojas, who has been charged with a second-degree felony for allegedly performing an abortion, has denied the allegations. Her legal team, including the Center for Reproductive Rights, welcomed the appellate court's decision, emphasizing the lack of evidence presented by the state.
