European Court of Justice Rules Against Kraftwerk in Longstanding Copyright Dispute
The European Court of Justice (ECJ) has ruled against Kraftwerk in a copyright infringement case that has spanned over two decades. The case involved an unauthorized two-second sample from Kraftwerk's 1977 song 'Metall auf Metall' used by producer Moses Pelham in the 1997 single 'Nur mir'. The ECJ determined that the sample was legal under the 'pastiche' provision, which allows for the use of creative work if it is noticeably different from the original and engages in artistic dialogue with it.
