FDA's Transparency Policy Faces Legal Challenges Amidst CRL Publication Controversy
The FDA's policy of publishing complete response letters (CRLs) has encountered legal uncertainties, as highlighted by recent developments. Initially introduced by former Commissioner Marty Makary in 2025, the policy aimed to enhance transparency for drug developers, investors, and patients. However, legal experts have raised concerns about the policy's compliance with existing regulations, which treat the existence of an application as confidential. Elizabeth Jungman, a former FDA chief of staff, noted that the agency had previously refrained from publishing CRLs due to these legal concerns. The FDA is now attempting to solidify the policy's legal foundation by proposing amendments to the Federal Food, Drug, and Cosmetic Act (FDCA) and publishing a rule on CRL releases. Despite these efforts, the policy's legal standing remains uncertain, with potential litigation anticipated.
