Texas Supreme Court Decision Highlights Importance of Timing in TCEQ Confidentiality Cases
The Texas Supreme Court has issued a decision emphasizing the critical role of timing in protecting sensitive information submitted to the Texas Commission on Environmental Quality (TCEQ). The court ruled in favor of TCEQ in a case involving the Texas Public Information Act (PIA), where the Sierra Club requested over 6,000 confidential documents. The court found that TCEQ adhered to the PIA's requirements by requesting an opinion from the Office of the Attorney General (OAG) within the mandated ten business days, thus avoiding the presumption that the information should be disclosed. This decision underscores the importance of precise procedural adherence, as missing statutory deadlines can significantly impact confidentiality claims.
