Mother Sues Ontario-Montclair School District After Disabled Son Nearly Drowns in School Pool
Monica Leiva has filed a lawsuit against the Ontario-Montclair School District after her 4-year-old disabled son, referred to as J.M., nearly drowned in a school pool. The incident occurred when J.M., who is nonverbal, autistic, and has spina bifida and hydrocephalus, was left unsupervised by the pools at Lincoln Elementary School. Despite having an individualized education plan requiring constant supervision, he was found face down and unresponsive in the water. The lawsuit alleges negligence and premises liability, seeking damages for medical expenses and emotional distress.
