Dallas Judge Extends Restraining Order in Surrogacy Custody Battle Over Newborn with Heart Defect
A Dallas County District Judge has extended a temporary restraining order for 14 additional days in a high-profile custody dispute involving a newborn with a rare congenital heart condition. The order prevents the surrogate, McKenna West, from seeing, holding, transporting, or making medical decisions for the child. West is seeking sole managing conservatorship of the baby, named Rumi Ali Ahmed by his genetic parents, Nausheen Gilkar and Omar Ahmed, but referred to as Baby Gabriel by West and her attorneys. The genetic parents had initially requested West terminate the pregnancy after the diagnosis of hypoplastic left heart syndrome (HLHS). West, an Alaska nurse, relocated to Texas to give birth, stating her intention to ensure the baby received necessary medical care. Gilkar and Ahmed testified that they never refused life-saving surgery and are committed to their child's treatment. The baby remains in critical condition following open-heart surgery, with potential complications requiring re-intubation.
