U.S. District Judge Rules 14th Amendment Protects Abortion Access for Health Risks, Setting Stage for Potential Supreme Court Review
U.S. District Judge B. Lynn Winmill has issued a ruling asserting that the 14th Amendment of the U.S. Constitution provides a limited right for pregnant patients to obtain an abortion if the pregnancy poses a risk to their health, including mental health. This decision marks the first time since the Supreme Court's 2022 Dobbs v. Jackson Women’s Health ruling that a federal court has found a constitutional right to abortion access under specific circumstances. The ruling specifically blocks the enforcement of Idaho's near-total abortion ban when a pregnancy is terminated due to such health risks. Idaho Attorney General Raúl Labrador has appealed this decision to the 9th U.S. Circuit Court of Appeals and requested a pause on the injunction during the appeal process. Legal experts suggest this ruling could initiate a gradual erosion of the Dobbs decision, mirroring how anti-abortion advocates incrementally challenged Roe v. Wade.
