Florida HOA Seeks Eviction of 28-Year-Old TikToker Over Age Restriction Violation
A legal dispute has emerged in a Jacksonville, Florida, 55-plus community where the homeowners' association (HOA) is attempting to evict Bethany Michel, a 28-year-old TikToker who inherited her late father's home. The HOA argues that Michel is ineligible to reside in the community due to age restrictions that require at least one occupant to be 55 or older. Michel, who was her father's primary caregiver, inherited the property after his death in 2023. The HOA has initiated a lawsuit to enforce the age restriction, which has led to a special assessment of $155,000 from residents to fund the legal action. Michel has taken to TikTok to express her frustration, highlighting the financial burden of having to pay both the assessment and her legal costs. Legal experts note that while ownership can be transferred, occupancy is subject to the community's age restrictions unless an exception is granted by the HOA board.
