Fort Collins Settles $500,000 Lawsuit Over Wrongful DUI Arrest
Jesse Cunningham, a military veteran, was wrongfully arrested for DUI by Fort Collins Police Officer Jason Haferman after stopping to assist at a motorcycle accident in July 2021. Despite Cunningham's insistence on his sobriety and requests for a breathalyzer test, Haferman arrested him, leading to a series of personal and professional repercussions for Cunningham. The charges were eventually dropped when lab results confirmed a 0.00% blood alcohol content. Cunningham filed a civil rights lawsuit, resulting in a $500,000 settlement from the City of Fort Collins, believed to be the largest for a wrongful DUI in U.S. history. Officer Haferman, who had a history of false arrests, resigned from the force in 2022.
