EPA Union Sues Management Over Contract Termination Following President Trump's Executive Orders
The American Federation of Government Employees (AFGE) Council 238, representing approximately 8,000 workers at the Environmental Protection Agency (EPA), has filed a lawsuit against EPA management. The union alleges that the EPA unlawfully terminated its collective bargaining agreement (CBA) in August 2025, following President Trump’s 2025 executive orders that aimed to ban collective bargaining on national security grounds. The lawsuit, filed in the U.S. District Court for Massachusetts, claims that the EPA violated its members' First Amendment rights and failed to comply with the Administrative Procedure Act's requirement for reasoned decision-making. The union further accuses the agency of waiting to discipline employees who criticized EPA Administrator Lee Zeldin until after the CBA was terminated, thereby circumventing protections related to scientific integrity and disciplinary procedures.
