US Judge Rules AI Chatbot Conversations Not Protected by Attorney-Client Privilege
A recent judicial ruling in New York has raised concerns about the use of AI chatbots in legal contexts. The case involved Bradley Heppner, former chair of GWG Holdings, who used Anthropic's chatbot Claude to prepare reports for his legal defense. Prosecutors argued that these AI-generated documents should be disclosed, as attorney-client privilege does not apply to chatbots. US District Judge Jed Rakoff ruled that Heppner must hand over 31 documents created with Claude, stating no attorney-client relationship exists between an AI user and a platform like Claude. This decision has prompted US lawyers to advise clients against using AI chatbots for legal matters, as such communications could be demanded in court.
