Federal Court Revives Radiologist's Lawsuit Over Support for Youth Trans-Care Ban
A federal court has reinstated a lawsuit filed by Dr. Eric Cubin, a radiologist, concerning his public support for a youth trans-care ban in Wyoming. The U.S. Court of Appeals for the 10th Circuit reversed a previous dismissal of Cubin's First Amendment claims, sending the case back to a district court for further proceedings. The court rejected the earlier ruling that dismissed Cubin's remarks as a private grievance. Dr. Cubin, who was a member of the Wyoming Medical Board, had urged lawmakers to support 'Chloe's Law,' which prohibits gender-affirming care for minors. This action led to his forced resignation by Governor Mark Gordon, who believed Cubin's stance could bias his judgment on other matters. The appeals court recognized Cubin's email to lawmakers as a matter of public concern, protected under the Constitution, and criticized the premature dismissal of his claims before discovery could be conducted.
