South Africa Files Genocide Case Against Israel at International Court of Justice
South Africa has initiated a legal case against Israel at the International Court of Justice (ICJ), alleging violations of the Genocide Convention in the Gaza Strip. The case, titled 'Application of the Convention on the Prevention and Punishment of the Crime of Genocide in the Gaza Strip (South Africa v Israel),' was filed on December 29, 2023. South Africa claims that Israel's actions in Gaza, including alleged killings, serious bodily and mental harm, and conditions of life capable of physical destruction, constitute genocidal acts against Palestinians. Israel refutes these allegations, arguing that its military operations target Hamas and not Palestinians as a protected group. The ICJ has issued provisional measures requiring Israel to prevent acts of genocide and ensure humanitarian assistance, but these are not final judgments on the merits of the case.
