Migrant Groups Challenge TPS Terminations with New Legal Strategy
Migrant groups are pursuing a new legal strategy to preserve Temporary Protected Status (TPS) for immigrants from several countries, following a U.S. Supreme Court decision that supported the Trump administration's authority to end the program. The plaintiffs argue that the Department of Homeland Security (DHS) lacked the authority to terminate TPS, a claim they are advancing in multiple lawsuits. They also contend that the terminations violated immigrants' due process rights under the Fifth Amendment. The cases involve TPS holders from countries like Burma, Ethiopia, South Sudan, Yemen, and Syria. The Department of Justice has been pushing for the removal of protections, but district courts have largely denied these requests pending new claims.
