Federal Court Rules Against Illinois In-State Tuition for Illegal Immigrants
A federal court has ruled unconstitutional the Illinois laws that provide in-state college tuition and certain state financial aid benefits to illegal immigrants. The ruling was in favor of the U.S. in its lawsuit against the State of Illinois, Governor Pritzker, and several state entities. The decision stems from a lawsuit filed by the U.S. Department of Justice’s Civil Division and the U.S. Attorney’s Office for the Southern Division of Illinois. The court has stayed its order for 14 days to allow the State of Illinois to decide whether to appeal. If no appeal is filed, the order will take effect in August, ending Illinois’ ability to provide these benefits through the RISE Act and Illinois DREAM Act.
