New Jersey Imposes Stricter In-Person Requirements for Telehealth ADHD Stimulant Prescriptions
Effective February 16, 2026, New Jersey has implemented a new state law requiring an initial in-person medical examination for individuals seeking Schedule II controlled substances, such as stimulant medications for ADHD, via telemedicine. This regulation also mandates an in-person visit at least once every three months for as long as the prescription continues. This New Jersey-specific rule applies irrespective of the federal waiver, issued by the DEA and HHS, which temporarily allows for the prescription of Schedule II through V controlled substances via audio-video telehealth without a prior in-person visit. The federal waiver, which has been extended multiple times since the COVID-19 public health emergency, is currently set to expire on December 31, 2026.
