Court of Appeal Upholds English Jurisdiction in International Divorce Case
The Court of Appeal in London has upheld a decision allowing Mrs. Caroline Ferrara, an Australian-born model, to pursue her divorce proceedings in England, despite having lived in Italy with her husband, Mr. Ferruccio Ferrara, since 2019. The couple, who met and lived in London for 20 years, married in Italy under a 'Separazione dei Beni' regime, which under Italian law, means each spouse retains exclusive ownership of their assets. This arrangement would have left Mrs. Ferrara without a share of her husband's assets in the event of a divorce in Italy. The English court's decision emphasizes the protective nature of its family law system, which focuses on fairness and meeting the needs of both parties, unlike the more rigid asset division laws in Italy.
