Environmental Groups Threaten Lawsuit Over Alleged Clean Air Act Violations by San Antonio Data Centers
Three environmental organizations, including the Environmental Integrity Project, Sierra Club, and Public Citizen, have issued a formal notice of intent to sue Vantage Data Centers and VoltaGrid. The groups allege that these companies improperly used streamlined state permits to bypass stricter federal air-pollution requirements under the Clean Air Act. The data centers, located in West San Antonio, are accused of potentially emitting significant amounts of pollutants such as nitrogen oxides, volatile organic compounds, carbon monoxide, and formaldehyde, a known human carcinogen. The facilities are situated in Bexar County, classified as a 'serious' ozone nonattainment area, which does not meet federal health standards for ozone. The environmental groups argue that the companies treated interconnected operations as separate minor pollution sources, thus avoiding major-source permits that require pollution controls and public participation.
