Arizona Appeals Court Vacates Manslaughter Sentence Due to AI-Generated Victim Statement
An Arizona appeals court has upheld the manslaughter conviction of Gabriel Paul Horcasitas, who was found guilty of fatally shooting another driver during a road-rage incident in Chandler. However, the court vacated his 10½-year sentence and ordered a resentencing. The decision to vacate the sentence stems from the trial judge's reliance on an artificial-intelligence (AI) recreation of the victim, Christopher Pelkey, speaking at the sentencing hearing. The appeals court ruled that this AI-generated depiction crossed the line between permissible victim-impact evidence and unreliable information, rendering Horcasitas’s sentencing fundamentally unfair. While the conviction for manslaughter remains intact, the case will be returned to the Maricopa County Superior Court for a new sentencing hearing, where the AI-generated statement will not be permitted.
