Maricopa County Attorney Declines Charges Against Parents in Toddler's Near-Drowning Case
In Gilbert, Arizona, the Maricopa County Attorney's Office has decided not to press charges against Angelo and Alexus Fiordilino, the parents of a toddler involved in a near-drowning incident. The case gained attention when the 18-month-old was mistakenly pronounced dead at Mercy Gilbert hospital on Super Bowl Sunday, only to be found alive later in the hospital morgue. The Gilbert Police Department had recommended child abuse charges against the parents, but the County Attorney's Office found that the evidence did not meet the legal standard required for prosecution. The investigation revealed that the family had implemented multiple childproofing measures and that several adults were present in the home, all believing the child was being supervised. No signs of impairment were found in the parents, and the case did not meet the 'reasonable likelihood of conviction' standard necessary for charges.
