Bank Faces Legal Challenge Over $3.85 Million Loan for Eroding Cape Cod Home
A legal dispute has arisen over a $3.85 million mortgage issued by JPMorganChase for a home on Cape Cod that was at risk of falling into the ocean due to severe erosion. The property, located on a bluff in Wellfleet, Massachusetts, was purchased by John G. Bonomi Jr. in 2021. Despite warnings about the erosion risk, Bonomi secured the loan and later had to demolish the house to prevent it from collapsing into the bay. Bonomi is now seeking to void the mortgage, claiming he lacked the mental capacity to enter the agreement and that the loan was unconscionable. JPMorganChase denies these allegations, asserting that it acted in good faith. The case highlights the complexities of appraising and insuring coastal properties, where the value of ocean views is often weighed against the risks of erosion.
