Justice Department Investigates Fairfax County Attorney for Alleged Discrimination in Plea Bargaining
The U.S. Department of Justice has initiated a federal investigation into the practices of Fairfax County, Virginia Commonwealth’s Attorney Steve Descano. The investigation, led by the Justice Department’s Civil Rights Division, will examine whether Descano's office has engaged in discriminatory practices by offering preferential treatment to illegal alien criminal defendants over U.S. citizens in plea bargaining, charging decisions, and sentencing policies. Assistant Attorney General Harmeet K. Dhillon emphasized that the Civil Rights Division aims to ensure that local prosecutors do not make decisions based on immigration status, potentially putting the community at risk. The investigation will be conducted under several statutes, including Title VI of the Civil Rights Act of 1964 and the Safe Streets Act. The Department has not yet reached any conclusions but has a history of conducting similar investigations that have led to significant reforms.
