Texas Court Blocks New Rules on Smokable Hemp Amid Legal Battle
A Travis County judge has issued a temporary injunction allowing Texas hemp businesses to continue selling smokable hemp products. This decision comes as part of an ongoing lawsuit challenging new state regulations that would have imposed stricter controls on hemp products. The injunction halts the enforcement of a new 'total delta-9 THC' standard, which included THCA in the legal THC limit for consumable hemp products. THCA is a compound in cannabis that converts to Delta-9 THC when heated. The ruling also blocks increased licensing fees and transport restrictions that were part of the new regulations. However, some provisions, such as child-resistant packaging and age restrictions, remain in effect. The state is expected to appeal the decision, while the Texas Supreme Court has allowed the continuation of a separate lawsuit regarding the criminalization of Delta-8 THC.
