Judge Sanctions DOJ Attorney Over ICE Detention Noncompliance
Judge Troy Nunley of the Eastern District of California has sanctioned Department of Justice attorney Jonathan Yu with a $250 fine for failing to comply with court orders to release an immigration detainee. This action comes amid a surge in habeas corpus petitions from detainees, with the Eastern District receiving over 2,700 petitions since January, a significant increase from previous years. The detainees, many of whom are longtime U.S. residents, are being held under a 'mandatory detention' policy implemented by the Department of Homeland Security. This policy, which previously applied only to those caught at the border, now affects all immigrants arrested, leading to a backlog in the courts as detainees seek release through legal petitions.
