Washington Judge Permanently Blocks Key Provisions of Sheriff Standards Law
A Thurston County Superior Court Judge, Christine Schaller, has permanently blocked key provisions of Washington's new sheriff standards law, Senate Bill 5974, ruling them unconstitutional. This decision follows a temporary block earlier in the year. The blocked provisions include requirements that a sheriff must be at least 25 years old, possess a minimum of five years of law enforcement experience, and have no felony or gross misdemeanor convictions. The law also aimed to allow the Criminal Justice Training Commission to revoke certification for misconduct, which would trigger automatic removal from office for elected sheriffs. While these specific requirements are blocked for elected sheriffs, they remain in effect for appointed sheriffs. Additionally, a separate provision restricting the use of police volunteers was not blocked by the ruling. The state of Washington plans to appeal this decision.
