Liew Rui Yan has identified and proposed a fix for a bug within the DAMON (Data Access MONitor) memory management subsystem of the Linux kernel. The issue, introduced by a previous commit (50585192bc2e), causes the last region of memory to be unconditionally skipped during processing, leading to it being permanently ignored. This occurs when a target has multiple memory regions (e.g., R1 and R2) and a quota is configured to process a limited number of bytes per window. In such a scenario, after processing the first region (R1) and filling the quota, the system incorrectly skips the subsequent region (R2) because it's identified as the 'last region,' even though it has not been processed. Liew Rui Yan has submitted a patch to address this problem and prevent future regressions, which has been reviewed by SJ Park.

Ninth Circuit Clarifies DMCA Liability for AI-Generated Code, Dismissing Programmers' Claims

The Ninth Circuit Court of Appeals recently upheld the dismissal of claims brought by software programmers against GitHub, Microsoft, and OpenAI under the Digital Millennium Copyright Act (DMCA). The programmers alleged that GitHub Copilot and OpenAI’s Codex violated DMCA Section 1202(b) by reproducing their copyrighted code without including copyright management information (CMI), such as original authors or licensing terms. The court concluded that the plaintiffs failed to demonstrate that the AI tools actively removed or altered CMI from existing works. Instead, the court found that the AI models generated new code that simply lacked CMI, rather than stripping it from pre-existing code. This decision distinguishes between claims concerning a model's inputs (removal of CMI before training) and its outputs (reproduction of material without CMI).
