The Justice Department refers to the situation as a 'pending criminal investigation' and a 'potential federal criminal prosecution.' Despite the dismissal of the previous case due to the unlawful appointment of interim U.S. Attorney Lindsey Halligan, the department plans to present the case to a grand jury again.
