Ohio Trench Collapse Kills One Worker, Injures Two After Warnings Ignored
A trench collapse near Milford, Ohio, on December 5, resulted in the death of 28-year-old Jose Alberto Barajas Martinez and severely injured two other workers. Federal investigators from OSHA found that the approximately 8-foot-deep trench lacked required cave-in protection, despite federal regulations mandating safeguards for trenches deeper than 5 feet. Workers had reportedly warned that the trench was dangerously deep but were instructed to enter it just minutes before the collapse. Whispering Creek LLC, the landscaping company involved, was cited for five safety violations and initially fined $231,714, a penalty later reduced to $49,000. Company owner David Baumgardner was present at the site and was aware of the trench's depth and layout. He told investigators he had used cave-in protections on previous jobs but claimed the workers were not deep enough to warrant them in this instance. Investigators accused Baumgardner of 'conscious disregard' and 'plain indifference' to safety requirements.
