Federal Judge Strikes Down Texas Law Restricting Drag Performances, Citing First Amendment Concerns
U.S. District Judge David Hittner has, for a second time, ruled Texas Senate Bill 12 unconstitutional. This law aimed to restrict what it termed 'sexually oriented performances,' a measure widely understood to target drag shows. Judge Hittner's decision reaffirms his 2023 ruling, stating that individuals who find such activities offensive have the simple solution of not attending. Texas Attorney General Ken Paxton has indicated plans to appeal this ruling. This decision is part of a broader national debate concerning drag performances, LGBTQ+ rights, and freedom of expression, with several Republican-led states enacting laws to limit drag shows, while Democratic states and civil rights organizations work to protect them as constitutionally protected artistic expression. Similar legal challenges have seen laws blocked in Montana, Florida, and Tennessee.
