Planned Parenthood's Fraud Appeal Dismissed by Fifth Circuit, Case Returns to District Court
The Fifth Circuit has dismissed Planned Parenthood's appeal regarding an interim ruling in a Medicaid fraud case, sending it back to a federal district court. The case involves allegations by a whistleblower, 'Alex Doe,' who claims Planned Parenthood affiliates continued billing Medicaid after their eligibility was terminated. The full Fifth Circuit ruled that the appeal could not be considered at this stage, rejecting Planned Parenthood's argument for attorney immunity under the collateral-order doctrine. The case will now proceed in the district court, where the nonprofit's attorneys are not immune from the False Claims Act lawsuit.
