US Big Tech Firm Equinix Faces Legal Challenge Over Cape Town Data Center Planning Gaps
U.S.-based multinational data center giant Equinix is facing a legal challenge in Cape Town, South Africa, regarding its plans to build a 174 MVA hyperscale data center. The appeal, launched by Foxglove and the Housing Assembly (HA) with legal counsel from the Legal Resource Centre (LRC), argues that Equinix's application contains significant gaps in critical planning information. These omissions include details on water usage, emissions, electricity consumption, diesel generators, air pollution, noise, and building plans. Despite these concerns, Cape Town's Municipal Planning Tribunal (MPT) voted to approve the data center's construction, though not unanimously. This legal action aims to halt the project until all necessary information is provided, allowing the community to make an informed decision about consenting to its construction. This case follows a similar successful challenge by Foxglove in the UK against another hyperscale data center.
