US Justice Department Intervenes in xAI's Legal Challenge Against Colorado AI Regulation
The U.S. Justice Department has intervened in a lawsuit filed by Elon Musk's artificial intelligence company, xAI, against a Colorado law aimed at regulating AI systems. The law, Senate Bill 24-205, is set to take effect on June 30 and imposes disclosure and risk-mitigation requirements on developers of 'high-risk' AI systems used in sectors such as employment, housing, education, healthcare, and financial services. xAI argues that the law violates the First Amendment by restricting how developers design AI systems and compelling speech on contentious public issues. The Justice Department's intervention claims the law also violates the 14th Amendment's equal protection guarantee by requiring companies to guard against unintended discriminatory effects while allowing some discrimination aimed at promoting diversity.
