Edgerton City Sues Residents Over Petition to Block Hyperscale Data Center Development
The city of Edgerton, Kansas, has filed a lawsuit against two Johnson County residents, Carrie Schmidt and Kimberly Twente, after they initiated a petition to prevent hyperscale data center development within city limits. The lawsuit claims that the submitted petition is administrative in nature, which is prohibited under Kansas statute, and seeks to void and invalidate it. The city argues that the proposed petition ordinance would cause future injury to the city and could not be repealed for 10 years. Schmidt and Twente, who launched a nonprofit to fund their legal efforts, contend that the lawsuit is an act of retaliation against their First Amendment rights. This legal battle is one of the first in the Kansas City metropolitan area to bring the ongoing debate between residents and cities over data center development into the courtroom.
