Federal Judge Rules Against First Amendment Protection for Personalized Algorithmic Feeds for Minors in California
Senior US District Judge Edward Davila has issued a ruling that challenges the First Amendment rights of social media platforms concerning personalized algorithmic feeds for minors. The decision allows California to enforce a law that generally prohibits platforms from delivering personalized algorithmic content to minors based on their viewing history and associated information, unless verifiable parental consent is obtained. Judge Davila distinguished between content moderation policies, which he suggested might merit First Amendment protection, and personalized algorithmic feeds, which he argued do not, as they merely reflect users' ascertained interests.
